 PRIVACY PRACTICES (HIPAA) POLICY

Zephyr Intellectual Services is a covered entity under the Health Insurance Portability and Accountability Act of 1996(HIPAA), as modified by the Health Information Technology for Economic and Clinical Heath Act (HITECH Act), and all implementing regulations. Among other things, HIPAA requires that Zephyr Intellectual Services safeguard certain health information that Zephyr Intellectual Services creates, receives, maintains, or transmits about clients. This information is called protected health information or PHI. PHI is health information that relates to the past, present or future physical or mental health or condition of an individual; the provision of health care to the individual; or the past, present, or future payment for the provision of health care to the individual and that identifies the individual or with respect to which there is a reasonable basis to believe the information can be used to identify the individual. Zephyr Intellectual Services shall protect all health-related information concerning the people we serve, our employees, volunteers, and contractors with whom we engage. This policy applies to all records of services maintained by Zephyr Intellectual Services and may vary from practices of other health care providers.

As required by law, Zephyr Intellectual Services shall:

· safeguard protected health information

· give notice of our legal duties and privacy practices with respect to protected health information

· follow applicable laws and guidelines should a breach of PHI occur

· follow the terms of this policy as currently in effect

· notify appropriate parties of any changes to this policy.

PURPOSE:

In order to provide quality health care services and to comply with legal requirements, Zephyr Intellectual Services create a record of the services we provide. In addition, we maintain records applicable to our employees that may include protected health information. Our policies and procedures are intended to safeguard protected health information as well as all other private information related to anyone associated with Zephyr Intellectual Services. Zephyr Intellectual Services will make reasonable efforts to document all compliance tasks and activities for protecting the privacy of PHI and to retain the documentation in accordance with HIPAA’s specifications.
